Can you buy psilocybin in Colorado?
This is the question I am asked most often by people who have never worked with a facilitator, and the way it is usually asked tells me what they picture: a counter, a menu, a card reader. Colorado did not build that. Understanding what it built instead saves people from the two things that go wrong here, which are wasting money on something unregulated and assuming the legal path does not exist.
The short answer
No. There is no legal retail sale of psilocybin anywhere in Colorado. Not in a dispensary, not in a wellness shop, not in a members-only club. If a business is selling psilocybin mushrooms across a counter, it is operating outside the law, and whatever else that means for them, it means the product has no testing, no dosing verification, and no accountability behind it.
What Proposition 122 actually did
Two separate things, and almost everyone hears only one of them.
The first: it removed state criminal penalties for adults 21 and over around personal possession, use, growing, and sharing without payment. Sharing without payment is the phrase that matters. The moment money moves, the exemption stops.
The second, and the one that took three more years to arrive: it directed the state to build a regulated program where supervised sessions could legally happen. That program began licensing in 2025. It is the only route in Colorado where a stranger can legally give you psilocybin, and it happens in a licensed room with a licensed person present, not in a bag.
So what does the legal route look like
You choose a facilitator and a licensed healing center. You go through an intake and eligibility review first, which is a real screening and can end in a no. You prepare. On the day, you are at the center for roughly six to seven hours, someone stays with you the entire time, and you do not drive yourself home. Then you integrate, a few days later, while it is still close.

The shops you have probably seen
Denver in particular has storefronts that lean hard on mushroom imagery. Most sell functional mushrooms, lion's mane and reishi and the rest, which are legal, uncontroversial, and not psychoactive in this sense. A smaller number sell products in a grey zone, sometimes labelled as a blend, sometimes with the active ingredient left carefully unnamed. Those are not part of the state program, they have no testing requirement behind them, and nobody in that transaction is licensed to be responsible for you.
The confusion is understandable. Denver voted to deprioritise enforcement in 2019, years before the state program existed, and the city has looked permissive ever since. Deprioritised enforcement is not a licensed market. Those are different legal facts that happen to live in the same city.
Why the difference is worth caring about
Not for moral reasons. For practical ones. In the regulated route someone screens you before anything happens, which catches interactions and histories that genuinely matter. Someone stays in the room for the whole thing. The premises are licensed, the product is tested, and if something goes sideways there is a person whose license is attached to how they respond. None of that exists in a transaction across a counter, and all of it is what you are actually paying for.
