Is psilocybin legal? What Colorado and Oregon actually allow

This is the question I hear first, and it deserves a plain answer. Psilocybin remains a controlled substance under federal law. At the same time, two states have built regulated programs where adults can legally work with it in supervised settings, and those two states happen to be the ones where I hold my facilitator licenses.

Colorado

In 2022, Colorado voters passed Proposition 122, the Natural Medicine Health Act. The state then spent two years building the rules before the first licenses were issued. Today, regulated access runs through licensed healing centers and licensed facilitators, overseen by the Department of Regulatory Agencies and the Department of Revenue. There is no retail sale. You cannot buy psilocybin at a shop, and nobody may sell it to you to take home. What the law created is a supervised experience: preparation, an administration session with a licensed facilitator present, and integration afterward.

Oregon

Oregon moved first. Measure 109, passed in 2020, created Oregon Psilocybin Services inside the Oregon Health Authority. The structure is similar in spirit: licensed service centers, licensed facilitators, products from licensed manufacturers, and sessions that happen on site rather than at home. Oregon's program has been serving clients since 2023.

What both programs have in common

Three things matter most. You must be 21 or older. The psilocybin itself comes only through the licensed system, never from a facilitator personally. And these are wellness programs, not medical ones: no diagnosis is required, no prescription exists, and facilitation is distinct from medical, psychiatric, or psychotherapy care. That last line is not fine print to me. It shapes how I hold every session.
